User hereby warrants and represents that User has the right to enter into this agreement and to grant the rights granted to the Epic and the City of Grand Prairie, herein.
The podcast booth and associated equipment are the sole property of the City of Grand Prairie and are made available for User’s private use. The podcast booth is not deemed to be a public forum and use of the podcast booth is subject to these rules and regulations. The creation of all content must be approved by the Parks, Arts, and Recreation Department and the Epic. The Epic reserves the right to prohibit the use of the podcast booth for any purpose that violates federal, state, or local law or these policies.
Because this podcast will take place at the Epic, a facility operated by the City of Grand Prairie Parks, Arts and Recreation Department, the podcast must align with city values. By executing this agreement, User is granted a non-exclusive, limited and revocable license to access the podcast booth and use its functionality only on the conditions set fort in this agreement, including the following:
1. Discrimination- Discrimination for any reason will not be tolerated in the Epic Podcast booth.
2. All Participants Must be ages of 18+ unless supervised by Parent/Guardian
3. Profanity/Offensive Language - Refrain from explicit content, profane/crude language, or content not suitable for and potentially offensive to all audiences, ages and backgrounds.
4. Politics/Current events – This podcast is meant to stay community based and if there is any news or political related content, we ask that it stays unbiased and factual.
5. Guests on your show must be approved by the Epic Management.
6. Podcasting for Profit – if generating revenue from Podcast, individual is liable for Business License and any associated fees and income taxes.
7. Violating Local, State and Federal Communication laws – User understands and will not violate any level of communication laws, Including Copyright, Publicity Rights, Public Domains and Trademark Laws.
8. Misuse or Damage – User understands that User is financially responsible for any damage to the Podcast booth studio including furniture, equipment, and fixtures.
RELEASE. User hereby releases and discharges the Epic, the Parks, Arts and Recreation Department, and the City of Grand Prairie, Texas, together with their officials, employees, agents, and affiliates, from any and all liability arising out of or in connection with the programming, the session, the making, producing, reproducing, processing, exhibiting, distributing, publishing, transmitting by any means, or otherwise using the Production.
INDEMNIFICATION. User agrees to defend and indemnify the Epic, the Parks, Arts and Recreation Department, and the City of Grand Prairie, Texas, together with their officials, employees, agents, and affiliates, from and against every claim, liability, damage, loss, and expense, including reasonable attorneys’ fees and costs, arising out of or in any way connected with: (i) User’s access to, use of, or alleged use of, the podcast booth; (ii) User’s violation of any portion of these terms, any representation, warranty, or agreement referenced in these terms, or any applicable law or regulation; (iii) User’s violation of any third party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; or (iv) any dispute or issue between User and any third party.
By clicking "I agree to the below terms", User agrees to adhere to the rules, regulations, and terms set forth by this agreement. Any deviation from the terms of this agreement will result in revocation of the license to use the booth.
